Ridgemark XI Homeowners Association – CC&Rs and Architectural Controls

Ridgemark HOA XI has rules and regulations by which the homeowners must abide by if they purchase property within the Ridgemark HOA XI community.  These rules and regulations are designed to preserve the community’s integrity and property values, distribute the cost of services, protect residents, and make the community a desirable place to live.  A copy of the CC&Rs and ByLaws are available on the association website.

Our HOA applicable rules and regulations are contained in the Covenants, Conditions and Restrictions (CC&Rs) of Ridgemark XI Homeowners Association.  You should take the time to be familiar with this document because each homeowner agreed to abide by the CC&Rs when purchasing their property in Ridgemark XI.  Also, as members of Ridgemark XI, you have elected Board members and have given the Board the charter to enforce the CC&Rs and ByLaws on behalf of the Ridgemark XI community.

One area of the CC&Rs that need your review are those that come under Article VI – Architectural Control.  The Board has an Architectural Committee that is responsible to oversee that owners conform to the Architectural Control sections of the CC&Rs.  Here is a review of those sections:

Section 6.01 – Review of Plans – Plans and specifications for proposed improvements shall be submitted to the Architectural Committee for review and approval  including without limitation driveways, solar equipment, swimming pools, spas, landscape design and capital improvements on any Lot of Ridgemark XI.  Plans and specifications should be submitted to Architectural Committee by personal delivery or certified mail.  The Architectural Committee will review the plans and provide approval as soon as possible but no more than 45 days.  Approval from the Committee can contain conditions or requests for modification of particular aspects of the owner’s plan and specifications.  Appeals from the decisions of the Architectural Committee may be made to the Board of Directors, which may elect, in its discretion, to hear the appeal, or, in the alternative, affirm the decision of the Architectural Committee.

Here are some recent instances where the Architectural Committee has been involved:

Landscape Changes: The Architectural Committee must approve all major landscape changes.  The committee may limit the height and density of trees and bushes, which may substantially interfere with the views from an adjoining lot or create a hazard at intersections.

Trees: No owner shall remove, injure, or destroy any tree existing on the date a lot was first conveyed in fee by declarant to such owner, nor any tree which has reached a height in excess of ten (10) feet, without the prior approval of the Architectural Committee.

Fences: No fence, hedge or wall exceeding six (6) feet in height may be erected on any Lot, except upon written approval from the Architectural Committee and/or the Board of Directors. Fencing shall be designed to allow for some movement of wildlife.  No fence, hedge or wall shall be erected, placed or altered on any Lot nearer to any Street than the minimum building setback line without the approval of the Architectural Committee of the Board of Directors. Fences or hedges constructed along any property line of a Lot may be limited to four (4) feet in height where in the opinion of the Board of Directors, they will otherwise block the prime view from adjoining Lots. Where fences or hedges are proposed to be constructed along any Lot line that borders on a fairway of the gold course, the design, materials, and height thereof shall be as approved by the Architectural Committee of the Board of Directors, the objective being in all such cases to provide protection to the Lot Owners while, at the same time, preserving appearances from the golf course.

Section 6.03 – Enforcement of Architectural Restrictions – If an owner makes an improvement, addition or change in his Residence or Lot without approval from the Board of Directors, the Association may direct that the improvement, addition or change be removed and in the event that the Owner fails to diligently comment action to remove or modify the work within thirty (30) days after receipt of a written demand for removal or modification, the Association may either enter upon the Lot to effect removal or commence legal action to compel removal.  Any costs and expenses incurred by the Association in the discharge of its responsibilities hereunder, including reasonable attorneys’ fees, may be recovered from the Owner by means of a Special Individual Assessment.

RIDGEMARK QUICKPASS GATE ENTRY SYSTEM

ALL RESIDENTS OF RIDGEMARK ESTATES ARE REQUIRED TO SETUP A QUICKPASS ACCOUNT

In 2008, the combined leadership of Ridgemark Estates homeowners associations established the use of RFID cards to activate resident gate entry.  The dual purpose of the cards is to ease access for homeowners and/or tenants and to provide a data base listing all vehicles owned and operated by Ridgemark residents.   This is essential to our guard service program providing a safer environment for our community.  Working in conjunction with the RFID cards is the QuickPass system which registers the current resident information and provides a system to authorize guest entry. 

If you do not have a Quickpass account please contact Thelander Management, below, for assistance.  You will be asked to provide an email so that you may receive a login and password from the QuickPass system. Once you have received the account activation email from QuickPass, you will need to log-in to your account. Note that your vehicle registration information will be updated with that currently on file.  You will need to maintain your contact information, by adding/removing temporary and permanent visitors, etc. When your visitors arrive at the front gate, this is the “Visitor List” that gate personnel use to log your guests in. Please contact Thelander Management should you have questions or need help logging into or navigating around in QuickPass.

If you do not have access to a computer system, Thelander can set up and maintain a QuickPass account for you entering your information including a permanent visitor list.  You must call the guards to register any temporary or duration visitors.

Please know that as of  AUGUST 1ST any and all guests will be turned away at the gate if: not registered as your guest on your QuickPass account or a call from the guards does not make verbal contact with you giving authorization for admittance. 

Please also know that if a resident is not properly registered, the guards cannot properly identify their authorized entry.  If you have not registered, the guards will provide you with a registration form.  You are required to register all vehicles and persons in your household to authorize their entry.  If not registered you and/or your family members could be turned away.

Painting and Landscaping changes need to be reviewed by the ARC per Section 6.01 and Section 7 of the CC&R’s.  A reminder will be posted on the website.

  • Ridgemark Estates Guards and Roads Council

Effective August 1, 2015, the Quick Pass Program will be enforced.  All visitors must be on the list to be admitted to the property.  Lists can be updated online.     A tracking system for the guards will record their location during their rounds.

  • Landscape Maintenance                                                          

Discussion with Cutting Edge regarding weeds on Ridgemark Dr. and  Paullus Dr.   The boundary with the golf course needs to be defined to determine responsibility of weed abatement.

Quote for bark replacement on above areas is $10,697. Committee to request more quotes.

Old Business: 

  • Street Parking

Issue resolved regarding truck.

  • Roads and speeding

Total cost of for each speed hump is $2500. Five would be needed. Comments were made in favor and against  the speed humps.   The item will be voted on by the homeowners.  Speed mitigation pots were mentioned as an alternative.

  • CSA#9 Funds

A request for CSA# Funds was requested on March 3. The following items were requested:

Stop sign at Paullus Drive and Ridgemark Drive.

5 Speed Humps.

Informational signs.

25 mph surface painting.

Permission to set up a portable radar trailer.

The budget is approved at the end of June.

  • RMK/JMK update

There is no update.  There is a May 15 deadline for resolution in order for the purchase to go further.

New Business:

  •  San Benito County Landscaping Watering Regulations: 

Odd addresses:  Tuesday and Saturday

Even addresses:  Wednesday and Sunday

No washing of driveways, etc.  No sprinkler usage from 9 am to 5 pm.

  • Block Party 2015

The Block Party will be on September 20, Sunday.  Time to be announced.

  • Street Cleaning Day is the third Wednesday of each month.

Annual Bill for trimming and maintenance paid.

Golfers are taking a shortcut up to the 8th tee box by driving up the tan bark on Ridgemark Drive.             Board indicated they would look into this issue and discuss with Ridgemark Golf and Country Club.

Old Business:

  1. Roads
    1. JMK claims there was no official road agreement made and has returned to using the roads for golf course maintenance.
    2. Recommendation to create a Speeding Campaign to constantly remind homeowners of the issue of speeding in the community. Jim Maestri will investigate the costs of purchasing a speed radar sign to be posted on the streets.
  2. Web Site
    1. A comment was made that web site is a good method of communication but recommended that is opened up for dialogue for homeowners. Bill Baker will look into this recommendation and the board will investigate other social media options such as a community Facebook page.
  3. Street Parking
    1. Mr. and Mrs. Tapolski addressed the board to discuss the permanent parking of his vehicle on the street which is common area as he feels he is in compliance with the CC&Rs because he moves the vehicle every 48 hours. Mr. Tapolski requested a formal letter in writing and will be seeking a legal interpretation to see if he should be allowed to continue to permanently park in the common area.  It is the opinion of the board that they are in violation of the CC&Rs because they use the garage to store motorcycles and recreational vehicles.

New Business: 

  1. Election Results – 55 Ballots were cast in the recent board election which represents a quorum. Parris Guinta and Heidi Lipp were elected the oath of office was conducted by Jim Maxwell.
  2. The board would like to thank Jim Maxwell and Bart Racca for their service to the community as they step down from their roles as president and vice president of the RMK Unit XI Homeowners Association Board.
